Pred 30. leti smo moja mati, moj oče, moj mož in jaz skupaj zgradili stanovanjsko hišo. Po materini smrti je oče lastnik te hiše do ene polovice. Oče že dve leti živi pri partnerki, s katero je varal mojo mamo skoraj vsa leta njunega zakona. Ne vem, ali sta poročena in ali ima pri njej začasno bivališče. Vem, da s to žensko nimata skupnih otrok. Ali je v primeru očetove smrti tudi ta ženska dedič? Za odgovor se vam že vnaprej zahvaljujem. Prijazen pozdrav! Saša
Da, če bo ob očetovi smrti med njima še vedno obstajala zunajzakonska skupnost (za katero prijavljeno skupno prebivališče ni nujni pogoj), potem je tudi ona očetova dedinja in deduje skupaj z vami in morebitnimi drugimi dediči.
Spoštovani najprej lep pozdrav. Pišem v imenu moje kolegice, nemške državljanke, ki ne govori slovensko. Pred enim mesecem ji je umrl mož - Slovenec z nemškim in slovenskim državljanstvom. Možu je oče doma v Sloveniji prepisal posestvo. Po njegovi smrti sta zakonca, ki sta bila brez otrok na tem posestvu podrla staro hišo in zgradila novo. Živela sta v Nemčiji v Slovenijo pa prihajala na dopust. Mož je imel še dve sestri. Ena je že pokojna in ima dva otroka, druga živi v Kanadi. Kot je do sedaj znano, mož ni naredil oporoke. moževo premoženje deduje žena (polovico), še živeča sestra (četrtino) in otroka pokojne sestre (vsak po eno osmino), razen če se kdo od njih odpove dedovanju.
Seveda pa ni rečeno, da sodi celotno posestvo oziroma njegova celotna vrednost v zapuščino. Povečanje vrednosti kot posledica gradnje nove hiše namreč lahko predstavlja skupno premoženje umrlega moža in žene, na katerem ima žena načelno polovični delež (lahko pa dokazuje tudi višji %). V zapuščino tako morda sodi zgolj vrednost zemljišča in povečana vrednost, ki predstavlja možev delež na skupnem premoženju zakoncev.

Pozdravljeni,za pokojnim očetom se bom bratu v prid odpovedal tretjine nepremičnine,ki bi zakonsko pripadala materi,meni in bratu.Prav tako se bo deležu po možu odpovedala mama.Brat bo meni izplačal nekaj gotovine v zameno za mojo tretjino .Zanima me,če bo ta vsota obdavčena,ali pa res ne bo potrebno meni plačati davka na to vsoto.Lep pozdrav in hvala za odgovor.

Tak dogovor med dediči v okviru zapuščinskega postopka bi se štel za dedni dogovor, sodišče ta dogovor povzame v sklep o dedovanju. Znesek, ki bi ga prejeli, bi se obravnaval kot dediščina in zato skladno s prvo točko prvega odstavka 9. člena Zakona o davku na dediščine in darila ne bi bil obdavčen oziroma ste kot dedič prvega dednega reda oproščeni plačila davka. Mora pa biti tak dogovor sklenjen v okviru zapuščinskega postopka, drugače bi se to štelo kot promet z nepremičninami in bi od tega morali plačati davek. To velja tudi, če bi se solastnina delila v nepravdnem postopku po koncu zapuščinskega postopka.

Pozdravljeni, stric je umrl v začetku julija, živel je sam, zato je policija vdrla v stanovanje. Vso dokumentacijo je policija poslala na Okrajno sodišče v Ljubljani. Zanima me, kot nečakinja kakšne imam možnosti do dostopa stanovanja in dokumentov strica, saj bo potrebno prijaviti zapuščino in pospraviti stanovanje. Zahvaljujem se vam za odgovor, lep pozdrav
Niste navedli, ali so policisti stanovanje zapečatili ali ne. Če ga niso, lahko vanj vstopite, če ste dedinja, sicer pa z dovoljenem dedičev (stričevi potomci, žena ali zunajzakonska partnerka ali partner). Če so ga, morate za vstop dobiti dovoljenje. Če ste zakonita dedinja (ker ni prej naštetih oseb), vas bo sodišče samo povabilo na zapuščinsko obravnavo, nič pa ni narobe, če že prej pošljete na sodišče izjavo, da se priglašate k dedovanju, pri čemer navedete stričeve podatke, vključno z datumom smrti.
Odpovedala sem se nujnemu deležu po smrti matere, v korist bratu. Pozneje se je izkazalo, da brat ni bil iskren ne z materjo in ne z menoj. Ali lahko preklicem svojo ODPOVED do nujnega deleža ?
Odpoved nujnemu deležu je dedna izjava, ki je načelno nepreklicna. Vendar pa sodna praksa dedno izjavo, ki ni odraz prave volje tistega, ki jo je podal (v tem primeru vas), oziroma je obremenjena z napakami volje (sila, grožnja, prevara, zmota), šteje za izpodbojno. Če se nasprotna stranka (v tem primeru brat) s tem ne strinja, je potrebno vložiti tožbo na sodišče za razveljavitev dedne izjave. Vaša navedba, da brat "ni bil iskren", je premalo, da bi lahko podali oceno o smiselnosti tožbe oziroma o možnostih za uspeh v postopku, ki bi tekel na podlagi vaše tožbe.

Pozdravljeni. Z možem sva se locila 3 leta nazaj. On je vložil tožbo katero je kasneje v postopku preklical, jaz sem pa želela ločitev in postopek nadeljevala. Po ločitvi sva ostala skupaj. Imava sina starega 9 let. Zanima me kaj mi pripada, če se zgodi smrt partnerja, ker nisva nikoli razdelila skupno premoženje. Ali bi bilo smiselno da podpiševa izjavo o zunajzakonski skupnosti, da bi bila bolj pomirjena, ker sem brala da mi po smrti partnerja nic ne pripada, ker nisem več zakonski dedič? Odgovor je odvisen od okoliščin vašega sobivanja z možem. Če gre za partnersko zvezo (čustvena, ekonomska, intimna skupnost), potem ima le-ta enake učinke, kot da bi bila (še vedno ali ponovno) v zakonski zvezi, torej poročena. Torej je vse, kar pridobita z delom, skupno premoženje. Če gre zgolj za sobivanje (kot "cimra"), potem to sobivanje nima nobenih premoženjskopravnih učinkov. Še vedno pa očitno tudi v tem primeru obstaja neko skupno premoženje (kot posledica prejšnje zakonske zveze), ki ni razdeljeno in na katerem imata verjetno oba določene pravice. Vsekakor bi bilo smiselno, da bi svoja premoženjska razmerja, vsaj za nazaj, lahko pa tudi na naprej, uredila z ustreznim sporazumom pri notarju, za kar pa se morata seveda oba strinjati z vsebino takega sporazuma.

Pozdravljeni. Moj stric je umrl, oporoke ni, nima zene in ne sina (sta umrla). Za njega je skrbela zenska, ki pa ni bila prijavljena pri njemu, bila je pooblascena za njegov racun, kljuce od hiše ima še vedno ona. Ne zeli jih predari, ker pravi da do zapusčinske pripadajo njej. Deniči so njegovi bratje ( 6 jih je imel od tega sta 2 umrla). In me zanima ali so dedici od teh 2 umrlih bratov otroci ali ne? In pa ali je ta ženska isto dedič?
Otroci umrlih bratov so dediči in dedujejo deleže, ki bi šli prej umrlima bratoma.
Ženska, ki jo omenjate, je dedinja, če ji je stric kaj zapustil z oporoko ali če bo uspela dokazati (listine, priče), da je med njo in stricem obstajala zunajzakonska skupnost, da sta torej živela kot življenjska partnerja. (Ne)prijava prebivališča je eden od indicev (ne)obstoja skupnosti, nikakor pa ne potrebni (niti nujno zadsotni) pogoj zanjo.

Če je izplačilo nujnega deleža ugotovljeno v obliki izvršilnega naslova (npr. pravnomočen sklep o dedovanju, pravnomočna sodba, sodna poravnava, neposredno izvršljiv notarski zapis, ...), je potrebno za izterjavo dolgovanega zneska vložiti predlog za izvršbo na sodišču. Če izvršilnega naslova še ni, ga je najprej potrebno pridobiti, prav tako preko sodišča.
Predpisana obrestna mera zamudnih obresti trenutno znaša 10,50% letno. Konkretni znesek zamudnih obresti si lahko izračunate na tej povezavi.

Pozdravljeni sedaj z že bivšim partnerjem imava 2 mladoletna otroka. Skupaj sva si uredila stanovanje, ki so mu ga starši kasneje prepisali z darilno pogodbo. V tem stanovanju sem sedaj ostala jaz z otrokoma. On si je zgradil hišo, z njim sobiva/živi nova partnerka. Midva nisva nikoli uradno/sodno uredila premoženja, niti glede otrok nisva uradno nič urejala. Torej na npr vlogi za otroške še vse šteje kot "družina" kljub temu, da to dejansko nismo več. Kaj in kako bi se zgodilo v primeru dedovanja po njem (torej mojem bivšem partnerju), če ni oporoke? In kako če je lastnoročno napisana, da vse zapušča otrokoma? Hvala in lep dan
Sklepamo, da med vama ni bila sklenjena zakonska zveza, pač pa je obstajala zunajzakonska skupnost. V primeru smrti brez oporoke bi zagotovo dedovala njegova otroka, zelo verjetno pa tudi njegova partnerka, saj med njima zelo verjetno obstaja zunajzakonska skupnost (ča pa sta vidva slučajno (še vedno) v zakonski zvezi, pa med njima ne more obstajati zunajzakonska skupnost in ona ni dedinja). Vsak od njih bi dedoval 1/3 premoženja. Lastnoročna oporoka je veljavna in v tem primeru otroka dedujeta vse premoženje, nova partnerka pa ima pravico do nujnega deleža, ki znaša 1/3 vsega premoženja. Če je to opcija, še sploh če se partnerki ne zaupa, svetujemo oporoko pri odvetniku ali notarju. Lastnoročni oporoki se namreč hitro lahko kaj "zgodi" in potem nastopi zakonito dedovanje, po tretjinah. Na vašem mestu bi razmislili tudi o zahtevku za povračilo vlaganj v nepremičnino (stanovanje) iz naslova vajinega skupnega premoženja, seveda pa boste morali, če se partner s tem ne bi strinjal, morali svoje pravice uveljavljati preko sodišča.

Načelno je tudi taka nepremičnina skupno premoženje zakoncev, kar pomeni, da ima žena ob razvezi zakonske zveze pravico do deleža na njej. Pogodba o dosmrtnem preživljanju se namreč šteje za t.i. odplačno pogodbo, torej se tretira podobno, kot če bi bila nepremičnina kupljena za denar, ki bi izviral iz dela ni iz časa trajanja zakonske zveze. Sodna praksa stoji na stališču, da je skupno premoženje tudi tisto premoženje, ki je pridobljeno na podlagi pogodbe o dosmrtnem preživljanju, čeprav je pogodbo sklenil samo eden od zakoncev, pri čemer celo ni nujno, da se obveznosti po pogodbi izpolnjujejo s strani obeh zakoncev. Sodna praksa šteje, da zakonec, ki je sklenil pogodbo, prispeva (s sredstvi ali z delom) k preživljanju, drugi zakonec pa prispeva svoje delo ali sredstva v njuno življenjsko skupnost in s tem krije manjkajoči delež v denarju, delu ali obojem za zakonca, ki je našteto namenil za preživljanje preživljanca. Morda bi se deležu žene lahko izognili, če bi dokazali, da so bila za preživljanje preživljanca namenjena izključno sredstva, ki so bila vaše posebno premoženje, npr. denar, ki je predstavljal darilo vam ali vašo dediščino.
Trinadstropna hisa. Brat z zunajzakonsko partnerico in hcerko zivita ze vrsto let v hisi z mamo in ocetom vsak v svojem stanovanju. Brat je po starsih prevzel tudi poslovni prostor in spp s katerim se prezivlja in vlaga v hiso. Nima nobenih dolgov. Jaz zivim v tujini s hcerko in imam stanovanjski kredit. Brat zeli ostati v hisi zato sva se sporazumno zmenila, da mi izplaca moj delez. On meni da mi pripada 1/4 ker je on le vlagal v hiso. Je to pravicno? Kako bi lahko zadevo pravicno resili?
Odgovor na vprašanje je odvisen predvsem od vrednosti vlaganj. Poenostavljeno: če bo vaše izplačilo današnje vrednosti 1/4 hiše enako ali večje, kot bi bilo izplačilo 1/2 vrednosti te hiše, kakršna bi bila brez bratovih vlaganj, potem po našem mnenju niste v ničemer prikrajšani.
Pri tem še opozorimo, da bi lahko tudi starša želela (kar še ne pomeni, da to tudi res želita) in z oporoko ali darilom ali kako drugače odredila, da brat dobi več od vas. Pri tem ju omejujejo zgolj določbe o nujnem deležu, ki znaša polovico zakonitega dednega deleža, torej v vašem primeru 1/4 (polovica od polovice hiše).
"Pravično" je na koncu karkoli, kar se z bratom dogovorita oziroma kar - če dogovor ni mogoč - na koncu odloči sodišče (ki angažira izvedenca oziroma cenilca gradbene stroke).
